Did The Insurance Adjuster Tell You The Accident Did Not Cause Your Injuries?

This happens allot in accidents in which insurance companies call “low velocity impacts.” Typically this occurs in accidents were the damages to your vehicle are less than an arbitrary amount determined by the adjuster (typically $1,500.00 or less).   Often the Insurance company will hire a Injury biomechanics expert to try and establish that the vehicle impact could not cause your injuries.

In 2006, the Arizona Court of Appeals decided whether the defendant could introduce a injury biomechanics expert to disprove that accident caused the Plaintiff’s injuries.  The Court stated that an expert does not have to be a doctor to testify whether the accident caused injuries.  Instead it is only required that the expert has specific knowledge that will assist the jury in answering the question: “did the accident cause the injury?”

Ultimately, the Court decided that the defendant could introduce this type of evidence.   So what should you do if your in an accident and the adjuster tells you “The Accident Did Not Cause Your Injuries”?   Be sure to contact a lawyer who practices personal injury law so he/she can explain your rights.
