If you were injured at work, due not to your employer’s fault but that of another, Arizona Law, limits your ability to seek a claim against the responsible party while making your worker’s compensation claim.  In Acosta v Kiewit-StundtArizona’s Court of Appeals Division 1 recently held that Arizona law an injured worker’s right to make a third-party claim is not automatically assigned to the Worker’s Compensation Carrier, thus the injured worker does not have to seek re-assignment to maintain his/her third-party action.  However, the Worker’s compensation carrier is not dependent on the injured worker and may file its own action against the at fault party.
