Various Changes Proposed to Law on Trusts and Estates

Even if you do not practice or regularly deal with trusts and estates, some of the proposed changes could have an impact upon you.  The changes include exemptions of certain trustee communications from the attorney/client privilege; allowing a truste to appoint all of the trust estate by restating the trust; removing notice requirements for transfer on death provisions; and prohibiting a settlor’s creditor from seeking to access more than the settlor’s interest in the trust.  For the proposed text of HB2403, click here.
