Lesson, Do Not Spit In My Burger

The Washington State Supreme Court recently issued a decision holding that a sheriff deputy who claimed a local establishment (Burger King) served him a burger with some employee spit could sue for emotional distress under the state’s product liability law.  The lawsuit arises from a 2009 incident where Burger King’s employee (who had a criminal record) spit in the officer’s burger.  The officer never ate the burger but discovered the slimy goo when he lifted his bun.
