Be Careful What You Tweet or Post on Facebook
An Arizona title company terminated Amy McClenathan for a post on her Facebook page. Approximately a year after the mother’s death she had posted in her status that some days she wished she would be fired so she could stay at home. The next day her employer obliged her request. The reason for her termination: her social media post. Mrs. McClenathan is not the first Arizona resident to suffer this fate. In 2010 the Arizona Daily Star terminated reporter Brian Pedersen for tweeting “You stay homicidal Tucson. See Star Net for the bloody deets”, commenting on Tucson’s high rate of homicide cases.
However, there is an argument that under NLRB Act employers cannot fire an employee merely because he/she may post something, there is protected social media speech about the workplace.
